1. Agreement to Terms

By accessing or using the Realty Web Design website and services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of them, you should not use this website or engage our services.

These terms apply to all visitors, clients, and any other parties who access or use our services.

2. Services

Realty Web Design provides website design and development, MLS and IDX integration, brand identity work, and ongoing support for real estate agents, teams, and brokerages.

Specific project scope, timelines, deliverables, and costs are set out in the individual written proposal provided to each client before work begins. That proposal, once accepted, governs the engagement alongside these terms.

3. Proposals & Pricing

Proposals are valid for 30 days from the date of issue unless stated otherwise, and are fixed-price for the scope described. Work falling outside that scope is quoted separately before it is started.

Payment schedules and accepted methods are set out in each proposal. A deposit is required before work commences.

4. Project Timelines

We make every reasonable effort to deliver within the agreed timeline. Timelines assume feedback and content are returned within the windows set out in the proposal, and may be affected by third-party dependencies such as MLS feed approvals or domain transfers.

We communicate anticipated delays as soon as they are known and work with clients to minimise disruption.

5. Client Responsibilities

Clients are responsible for providing content, brand assets, and access to the accounts required to complete the work, and for confirming they hold the rights to any material supplied to us.

Clients are responsible for obtaining and maintaining their own MLS or IDX feed agreements. We can assist with the technical side of an application, but the agreement itself is between the client and their board or vendor.

6. Ownership & Intellectual Property

On final payment, ownership of the delivered website — code, design files, and content we produced for you — transfers to the client outright. Repositories, hosting, and domain accounts are handed over at launch. There is no lock-in.

We retain ownership of our underlying tooling, internal libraries, and general know-how, and the right to reuse them on other projects. Third-party components remain subject to their own licences.

7. Warranties

We warrant our work for 90 days from launch. Within that window we will correct defects in what we built at no cost.

The warranty does not cover changes made by the client or a third party after handover, failures in third-party services, or issues arising from content or credentials outside our control. Ongoing coverage is available under a care plan.

8. Search Rankings & Results

We build sites to be fast, accessible, and structured for search engines, and we will tell you honestly what we expect that to achieve.

We do not guarantee specific search rankings, traffic volumes, or lead counts. Those outcomes depend on your market, your content, your competitors, and search engine behaviour that no agency controls.

9. Cancellation & Changes

Either party may end an engagement with written notice. Work completed and third-party costs committed up to that point remain payable.

Change requests that alter the agreed scope are documented in writing and may affect both timeline and cost.

10. Limitation of Liability

Realty Web Design is not liable for indirect, incidental, or consequential damages arising from the use of this website or our services. Our total liability for any claim shall not exceed the amount paid by the client for the project in question.

We are not responsible for losses arising from third-party service outages, including hosting, MLS or IDX feeds, and email delivery providers.
